NSCDC: Prosecutor / Defence Counsel In Face Off Over Delay In Court Process

As the hearing into a matter between Nigerian Security and Civil Defence Corps, NSCDC and two Pastors of Evidence of Christ Church, Ilorin continued on Monday before Magistrate I. A. Dasuki.

As the proceeding continued, the prosecution counsel, Barrister Kehinde Ajide sought an adjournment into the matter on the premise that a witness in the suit that ought to be present for cross examination could not come because he was having an examination to write in his school on Monday.

However, the lead defence counsel, Barrister Lanre Badmus who had earlier expressed displeasure over the attitude of prosecution counsel, Barrister Kehinde Ajide moved for the termination of proceeding since the prosecutor seems not forthcoming in proving his matter, citing his earlier absence from court without notice.

Badmus was of the opinion that his clients suffer unduely from the lackadaisical attitude of the prosecutor wondering why another adjournment was being sought.

In a swift reaction, Barrister Kehinde Ajide raised objection stressing that the non availability of his witness is not his fault and that he still has grounds to forge ahead in the matter.

At a point he lamented, “I cannot manufacture evidence” arguing that the matter be adjourned to another convenient date.

You will recall that the NSCDC had instituted litigation against two Pastors Olumide Peter and Jesulayomi Adetola of Evidence of Christ Fellowship International Church before the Ilorin Magistrate Court on charges bothering on criminal conspiracy, unlawful assembly, accepting money from a foreign based organization, wrongful confinement and putting person in fear of injury in order to commit extortion.

Magistrate I. A. Dasuki eventually danced to the request from Barister Kehinde Ajide for a convenient adjournment date and so matters was adjourned till 6th September, 2021.
