N8bn CBN Currency Scam: Court Dismisses 5 Accused’s No-Case Submission

Justice Nathaniel Ayo-Emmanuel of the Federal High Court, Ibadan, on Tuesday dismissed the no-case submission made by five defendants being charged with N8 billion Central Bank of Nigeria currency scam.

The five accused persons who filed the no-case applications are Patient Okoro, Johnson Afolabi, Adekunle Ilori, Kolawole Babalola and Fatai Adedokun.

According to Ayo-Emmanuel, the accused have been unable to convince the court why they should not be made to face trial for the alleged fraud.

“It is not in doubt that the prosecution has been able to establish the fact that the defendants have explanations to make before the court in respect of the seven-count charge against them.

“However, I will uphold the no-case submission filed by all the defendants in respect of count three because the prosecution has not been able to prove beyond reasonable doubt that each of the defendants committed the crime on count three.

“The defendants are hereby discharged of count three for want of evidence.

“As far as counts one, two, four, five, six and seven are concerned, the defendants must each explain their roles in the circumstances that led to the fraud.

“In conclusion, the defendants are hereby directed to enter their defence as stated in the findings of the court in respect of this ruling,” the judge said.

Ayo-Emmanuel adjourned the case until July 2 for the accused’s counsel to commence defense.

Okoro, Afolabi, Ilori, Babalola and Adedokun along with others have since 2015 been facing multiple charges bordering on conspiracy, unlawful conversion, stealing and re-circulation of mutilated currency at Ibadan office of CBN.

Four of the accused — Ademola Oni, Tope Akintade, Olunike Afolabi and Kayode Togun — have at different times opted for plea bargain by pleading guilty and were convicted and sentenced to various prison terms.
